Welcome to CUSP PUBLIC, a service provided by 3Si (“Company”, “we”, “us”, or “our”). CUSP PUBLIC provides access to Data as defined herein. By accessing or using the CUSP PUBLIC service, you agree to be bound by these terms and conditions. If you do not agree to all the terms and conditions, do not access or use the service.
 
Definition of Data
“Data” refers to publicly available information pertaining to early childhood, including but not limited to, census data, health and development indicators, education statistics, and other related datasets. This data is often a compilation or blend of various public sources, aggregated and made accessible through CUSP PUBLIC.
 
Grant of License
Subject to these terms and conditions, we grant you a non-exclusive, non-transferable, limited license to access and use the Data for any lawful purpose. However, you shall not use the Data to develop, operate, maintain, or enhance any product or service that is competitive to those offered by 3Si.
 
Disclaimers
The Data is provided on an “as-is” and “as-available” basis. 3Si expressly disclaims any and all warranties, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, completeness, or usefulness of the Data, and you rely on it at your own risk.
 
Limitation of Liability
You agree to hold harmless 3Si, its affiliates, officers, agents, employees, and licensors from any claim, demand, loss, liability or expense arising out of or related to your use of the Data. 3Si will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the Data.
 
No Continuing Obligation
We are under no obligation to continue providing the Data and reserve the right to cease providing access to the Data at any time without notice. Additionally, we have no obligation to update the Data, and we make no representation regarding the timeliness of the Data provided. We may terminate your access to the Data without notice or liability for any reason whatsoever, including without limitation if you breach these terms and conditions.
 
User Information
To access the Data, you may be required to provide certain information about yourself. The collection and use of your information will be in accordance with the 3Si Privacy Policy (https://team3si.com/privacy-policy/), which is incorporated into these terms by reference.
 
Governing Law and Choice of Forum
These terms and conditions are governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to, or use of, the Data or these terms and conditions may be instituted only in the state or federal courts located in King County, Washington. You agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
 
Entire Agreement
These terms and conditions constitute the entire agreement between you and 3Si regarding the Data and your use of the Data. They supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and 3Si with respect to the Data.
 
By accessing or using the Data, you acknowledge that you have read these terms and conditions, understand them, agree to be bound by them. If you are agreeing to these terms and conditions on behalf of your employer or any other entity, you represent that you have the proper authorization to bind that entity to this legal agreement.
